My mother and I bought the house together for $ 105K in 2007 . And now we want to get out of the mortgage because they can not afford to pay more . Although they are current, yet filed for loan modification. But from reading many other posts / comments online , that does not sound like it could be approved for the loan modification . I think that 's not fair ! But no matter , because the two are going to leave this house . We have a short sale . MedlinePlus MedlinePlus But the question is how to sell quick sale? The market is not so great , and my house needs some major repairs . We do not have the money for repairs . None at all . We barely have enough money to pay all our bills including the mortgage . Need some advise on my mom's home. She hired a firm to do a modification for her home loan payment back in Sept of 2010. Modification went to the lender for review, still waiting to hear back. Was served with papers for complaint and summons from the bank. She has dementia and is not mentally stable to stand in court to represent herself fully or answer questions appropriately so question is, being I am her POA, should I just consider going for a short sale and be done with her home and avoid foreclosure or proceed with the nerve wracking answer and motion deal to set the foreclosure intention back some in hopes the modification will be decided in her favor by then? It's very nerve wracking. Also, if she has her name on another property but her son is mentally disabled and has a reverse mortgage out with a different lender on that home, (I am his guardian), can the bank take this property as well if her original home goes into foreclosure? I was told being her son is mentally disabled, they can not take a home away from him or me for being his care taker but not sure just how true this is. This is in the wonderful corrupt state of New Jersey by the way. Any advise or suggestions would be greatly appreciated. This is such a stressful situation to deal with. Please help!! Our home is in foreclosure status. We've attempted a modification, but the lender has only agreed to freeze our 11% interest rate & tack on the $16k in fees to the end of the loan. The house has been for sale for almost 3 years. This is a $140k house we're talking about. My husband has a 4 hour commute (2 to wk & 2 home) each weekday. At this point would it be best on our credit do to a short sale or deed in lieu?

This is semi - complex questions and multiple . My property is on the market in California and will now be a short sale if I receive an offer . Was refinanced in 2005 , non-cash , which we now know is a horrible loan nationwide . I owe $ 100.00 more than what you paid and the loan continues to build . I have tried to modify without luck due to the dramatic loss of income. I do not live in this house anymore, but it is an owner-occupied loan . Is this considered a loan application ? I signed papers on a used car dealer (in MA), but we took our " old" car home for the night to clean and leave our "new " car in the parking lot of banking. Now I have buyer's remorse . My husband and I are in the process of buying a house ( a short sale ) that made the offer for 30 days and was accepted by the seller . A few days ago , the bank ( Bank of America ) , accepted the terms of our offer as well, but demanded the closing date to be May 18 --- just two weeks after accepting . 45 days normally permit . My house is currently in the Arizona MLS and last night I was contacted by " fast home offer.com " or fasthomeoffer.com MedlinePlus The man said he wants to bid on our house and asked me questions like what is included in , do we have tenants currently there, do tenants pay their rent on time , the house is in good condition , our mortgage loans ( 1st and 2nd) and contact information of our realtor . He said he would call our real estate agent and make an offer . I do not want to get my hopes up and I wonder if this company is legit ? Has anyone experienced this company making an offer on a house for a short sale and if your offer was decent enough that banks will accept it ? The fair market value of our home is $ 100,000 at this time and has been on the market for 70 days .
